Terms and Conditions

Last updated: 28 September 2026

These Terms and Conditions apply to the provision of products and services by Derby Trade Windows (“we”, “us”, “our”) to customers (“you”, “your”).

By requesting a quotation, placing an order or engaging us to provide products or services, you agree to these Terms and Conditions.

1. About us

Business name: Derby Trade Windows
Website: derbytradewindows.co.uk
Business address: 196 Cotton Lane, Osmaston, Derby, DE24 8GH
Email: info@derbytradewindows.co.uk
Telephone: 07442 530114

2. Quotations

Any quotation we provide is based on the information available to us at the time of quotation.

Unless otherwise stated in writing:

  • Quotations are valid for 30 days from the date issued.
  • A quotation is not a binding contract until you have accepted it and we have confirmed your order.
  • Prices are based on the products, specifications and work described in the quotation.
  • Any additional work or changes requested by you may result in additional charges.
  • We reserve the right to correct genuine errors or omissions in a quotation before an order is accepted.

Where a quotation is based on measurements or information supplied by you rather than measurements taken by us, the final price may need to be adjusted if the actual requirements differ.

3. Orders and acceptance

An order becomes binding once:

  1. You have accepted our quotation or otherwise agreed to proceed; and
  2. We have confirmed acceptance of your order.

We will provide you with details of the products and services included in your order.

You should check these details carefully and notify us as soon as possible if anything is incorrect.

4. Product specifications

We will make reasonable efforts to ensure that products supplied match the agreed specification.

Minor variations in colour, finish, texture, grain, glass appearance or other characteristics may occur due to manufacturing processes, materials, lighting, screen displays or natural variations.

Product images displayed on our website are for illustration purposes and may not exactly represent the finished product.

Where a product is manufactured specifically to your requirements, changes or cancellation may be restricted once manufacture has commenced.

5. Survey and measurements

Where we carry out a survey or measurement, the measurements will be used to determine the appropriate products and installation requirements.

You must provide us with accurate information about the property and notify us of any circumstances that may affect the work, including known structural issues, access restrictions, shared access arrangements or other relevant matters.

Our quotation may need to be revised if conditions discovered during the survey or installation differ materially from those reasonably expected.

6. Deposits and payments

Any deposit or payment required will be stated in your quotation or order confirmation.

Unless otherwise agreed in writing:

  • Deposits must be paid before work or product manufacture begins.
  • The remaining balance is payable in accordance with the payment terms stated on your quotation or invoice.
  • You must not withhold payment for amounts that are not genuinely disputed.
  • If payment is overdue, we may suspend further work or delivery until outstanding amounts are paid.

All prices will specify whether VAT is included where applicable.

7. Changes to your order

If you request changes to an order after it has been accepted, we will advise you whether the change is possible.

Changes may result in:

  • Additional costs
  • Revised installation dates
  • Changes to product availability
  • Changes to the original quotation

We will seek your agreement to any significant additional cost before carrying out additional chargeable work.

8. Installation

We will carry out installation with reasonable care and skill.

Installation dates and times provided are estimates unless expressly agreed otherwise in writing.

You must provide reasonable access to the property and the areas where work is to be carried out.

You are responsible for:

  • Ensuring we have reasonable access to the property
  • Removing personal belongings or furniture from the immediate work area where reasonably necessary
  • Informing us of any relevant access restrictions
  • Obtaining any permissions that are your responsibility as property owner or occupier

We will take reasonable care of your property while carrying out the work.

9. Existing structures and unforeseen issues

When replacing windows, doors or other building elements, concealed conditions may not be apparent before removal of the existing installation.

If we discover structural damage, damp, rot, unsuitable substrates, defective lintels, inadequate supports or other unforeseen conditions, we will explain the issue to you where reasonably possible.

Additional work required as a result may be chargeable.

We will seek your agreement before carrying out significant additional work wherever reasonably practicable.

10. Completion and snagging

When installation is substantially complete, you should inspect the work and notify us of any genuine defects or outstanding snagging items as soon as reasonably possible.

We will investigate reported issues and, where appropriate, arrange reasonable remedial work.

Minor snagging or adjustments will not normally entitle you to refuse payment of an otherwise undisputed balance.

11. Damage and making good

We will take reasonable care to minimise disruption and damage during installation.

However, installation work can sometimes cause unavoidable minor disturbance to existing plaster, render, paint, brickwork, tiles, sealants or other surrounding finishes.

Unless expressly included in your quotation, extensive redecoration, plastering, rendering, tiling, painting or other remedial building work is not included.

Where making good is included, the extent of the work will be as specified in your quotation.

12. Cancellation and your statutory rights

If you are a consumer, you may have rights to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, particularly where the contract is entered into online, by telephone or away from our business premises.

However, cancellation rights can be affected by circumstances such as products being made to your specifications or work being carried out at your request during a cancellation period.

Nothing in these Terms and Conditions is intended to remove or restrict any statutory rights you have as a consumer.

Where you have a statutory right to cancel, we will provide the relevant cancellation information and procedure where applicable.

13. Consumer rights

Nothing in these Terms and Conditions affects your statutory rights under applicable UK law.

Where products are supplied to a consumer, the products will be of satisfactory quality, fit for purpose and as described, subject to the rights and conditions provided by applicable law.

Where services are supplied to a consumer, they will be carried out with reasonable care and skill as required by applicable law.

14. Guarantees and warranties

Where applicable, products may be supplied with a manufacturer’s guarantee or warranty.

The specific duration and terms of any manufacturer guarantee will depend on the product supplied.

Any additional installation warranty offered by Derby Trade Windows will be stated in writing.

Manufacturer warranties may be subject to conditions, exclusions and registration requirements.

A guarantee does not affect your statutory rights.

15. Faults and repairs

If you believe there is a problem with a product or installation, please contact us as soon as reasonably possible.

We may ask for photographs, videos or other information to help us assess the issue.

Where appropriate, we may arrange an inspection.

If the issue is covered by our obligations or an applicable warranty, we will take reasonable steps to repair, replace or otherwise remedy the issue in accordance with your legal rights and the relevant warranty terms.

16. Exclusions

We are not responsible for defects, damage or failure caused by:

  • Accidental damage after installation
  • Misuse or neglect
  • Failure to follow product care or maintenance instructions
  • Unauthorised alterations or repairs
  • Normal wear and tear
  • Damage caused by third parties
  • Structural movement or defects outside our control
  • Circumstances that could not reasonably have been identified before installation

These exclusions do not limit any statutory rights that cannot legally be excluded.

17. Customer responsibilities

You must provide accurate information that we reasonably require to supply the products and services.

You must also tell us about any relevant circumstances that could affect the installation.

If delays or additional costs arise because information provided by you is inaccurate or because reasonable access is not available, we may need to revise the installation arrangements or charge for additional work.

18. Delays

We will make reasonable efforts to meet agreed or estimated timescales.

However, we are not responsible for delays caused by circumstances beyond our reasonable control, including:

  • Manufacturing delays
  • Product shortages
  • Supplier delays
  • Severe weather
  • Transport disruption
  • Industrial disputes
  • Government restrictions
  • Utility or property-related problems
  • Unforeseen structural or building conditions
  • Events outside our reasonable control

Where a significant delay occurs, we will communicate with you and take reasonable steps to minimise its impact.

19. Website information

We aim to keep the information on our website accurate and up to date.

However, information, product descriptions, photographs, specifications, colours and prices may change from time to time.

Website content is provided for general information and does not form part of a contract unless specifically incorporated into your quotation or order.

20. Intellectual property

Unless otherwise stated, the content of our website, including text, photographs, graphics, logos and other materials, belongs to Derby Trade Windows or is used with permission.

You may not reproduce, copy, modify, distribute or commercially exploit our website content without our prior written permission.

21. Limitation of liability

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we will only be responsible for losses that are reasonably foreseeable and arise directly from our breach of contract or failure to exercise reasonable care and skill.

We will not be responsible for indirect or consequential losses where the law permits such exclusion.

Nothing in this section affects your statutory rights as a consumer.

Our Privacy Policy explains what information we collect, how we use it and your rights.

24. Governing law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights you may have as a consumer.

We may update these Terms and Conditions from time to time.

The version applicable to your order will normally be the version in force when your order is accepted, unless a change is required by law or agreed with you.
